Acceptance of Terms By creating an account, accessing, or using the AaharIQ platform (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you ("User") and AaharIQ ("we", "our", "us"). If you are accessing the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms, and "you" refers to both you individually and that entity. If you do not agree to these Terms, you must immediately cease use of the Service and delete your account. ## 2. Description of Service AaharIQ provides an AI-powered health and nutrition intelligence platform that enables users to: - Scan product ingredients and receive AI-generated risk assessments - Upload personal medical documents for personalised health context - Interact with AI chatbots specialising in health and nutrition guidance - Use voice-based interaction for hands-free product assessment - Analyse medical images using AI The Service is provided on a subscription basis, with certain features restricted to paid plans as described on our pricing page. ## 3. User Accounts To access the Service, you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. We reserve the right to suspend or terminate accounts that contain false or misleading information. You must be at least 18 years of age to create an account. By registering, you represent and warrant that you meet this requirement. ## 4. Subscription Plans & Billing AaharIQ offers multiple subscription tiers including Free, Basic, Premium, and Platinum plans. Each plan carries different feature entitlements and usage limits as published on our pricing page, which we may update from time to time. Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by applicable consumer protection law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and you retain access to paid features until that date. We reserve the right to modify subscription pricing with 30 days' notice. Continued use of the Service after the effective date of any price change constitutes your acceptance of the new pricing. ## 5. Acceptable Use You agree not to: - Use the Service for any unlawful purpose or in violation of any applicable laws - Attempt to circumvent authentication, rate limits, or access controls - Introduce malware, prompt injection attacks, or other malicious content into the Service - Scrape, crawl, or systematically extract data from the Service without prior written consent - Impersonate any person or entity, or falsely represent your affiliation with any person or entity - Use the Service to provide professional medical diagnoses — the Service is not a substitute for qualified medical advice - Resell, sublicense, or commercialise access to the Service without our express written permission ## 6. Intellectual Property All content, features, and functionality of the Service — including but not limited to software, AI models, design, text, graphics, and data compilations — are the exclusive property of AaharIQ and are protected by applicable intellectual property laws. You retain ownership of any health data, documents, and content you upload to the Service. By uploading content, you grant us a limited, non-exclusive licence to process that content solely to provide the Service to you. We do not claim ownership of your personal data. ## 7. Medical Disclaimer AaharIQ provides information and AI-generated analysis for general health and nutritional awareness purposes only. The Service is **not** a licensed medical device, and its outputs do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making any decisions that may affect your health, especially if you have a medical condition, are pregnant, or are taking medication. Reliance on any information provided by the Service is solely at your own risk. ## 8. Limitation of Liability To the maximum extent permitted by applicable law, AaharIQ and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid us for the Service in the 12 months preceding the claim. ## 9. Termination We may suspend or terminate your access to the Service at our discretion, with or without notice, if we believe you have violated these Terms or if your use of the Service poses a risk to other users or the integrity of the platform. Upon termination, your right to use the Service ceases immediately and we will delete your personal data in accordance with our Privacy Policy. ## 10. Governing Law These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. ## 11. Changes to These Terms We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice before material changes take effect, either by email or via a prominent in-app notice.
